Terms of Service

1. Who we are

Campfire (campfireclub.lol, together with its desktop app, overlays and browser sources, the "Service") is operated by Jared DeFriese, an individual sole proprietor ("Campfire", "we", "us"). Campfire lets a streamer's community gather as animated characters around a shared campfire, in rooms and in venues, alongside a Twitch stream.

By creating an account, signing in, or buying anything on Campfire, you agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy. If you don't agree, please don't use the Service.

2. Who can use Campfire

You must be at least 13 years old, and old enough to use Twitch where you live. If you are under 18 (or the age of majority where you live), you may only use Campfire with the permission of a parent or guardian, and only a parent or guardian may make purchases for you. You may not use Campfire if we have previously banned you or if the law forbids it.

3. Your account

You can sign in with your Twitch account or with an email and password. You're responsible for keeping your login secure and for everything that happens under your account. Give us accurate information, keep your email current, and tell us right away at support@campfireclub.lol if you think someone else has accessed your account. One account per person; don't share, sell or transfer accounts.

Usernames and display names must not impersonate someone else or infringe anyone's rights. We may reclaim or change a name that breaks these Terms.

4. Twitch and other services

Campfire is an independent service. It is not made, endorsed or sponsored by Twitch Interactive, Inc. or Amazon. When you connect Twitch, you authorize Campfire to use the permissions you approve on Twitch's sign-in screen (for example, reading chat in a channel where a campfire is lit, or posting messages you send from Campfire). You can revoke this any time in your Twitch connection settings, though parts of Campfire will stop working.

Your use of Twitch remains subject to Twitch's own terms and community guidelines. Creators may also show content from other services in their spaces (such as video, music or chat emotes from YouTube, Spotify, SoundCloud, Vimeo, BetterTTV, FrankerFaceZ or 7TV). Those services are run by others, and we aren't responsible for them.

5. Creators and their spaces

"Creators" are accounts we have approved to host a campfire, room or venue. Creator status is granted at our discretion and may be removed if a creator breaks these Terms. Hosting a space requires an active Membership, and some tools (such as venues) require an additional paid plan.

Creators are responsible for their space: what they put in it, the content and links they embed, the commands and settings they configure, and moderating their community. Creators must have the rights to everything they upload or embed, and must follow Twitch's rules for their channel. Creator coins and any rewards a creator offers in their space are the creator's choice; we provide the tools but don't guarantee any creator's offerings.

6. Your content

You keep ownership of what you create and upload: sprites, emotes, decorations, room layouts, chat messages and so on ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and transmit Your Content only as needed to run, show and improve Campfire, including showing it to the other people in the spaces where you use it and in creators' stream overlays. This license ends when you delete the content or your account, except for copies other people have already captured (for example, in a recorded stream) and backups that are deleted on their normal schedule.

Only upload content you have the right to use. We may remove any content that we believe breaks these Terms or the law. If you believe content on Campfire infringes your copyright, email support@campfireclub.lol with the work, where it appears on Campfire, your contact details, and a statement that you believe in good faith the use isn't authorized. We'll respond promptly and remove infringing material, and we will terminate repeat infringers.

7. Rules of conduct

Don't use Campfire to:

Creators may kick, ban or moderate people in their spaces. We may also remove content, reverse coins or items obtained by breaking these rules, and suspend or end accounts.

Membership is a subscription that unlocks member features and, for approved creators, lets you host your own space. Some accounts may be invited to a yearly Grant membership at a special price; Grant invitations are personal and can't be transferred. Approved creators may also buy add-on plans, such as the Venue plan. Add-ons require an active Membership and end automatically if your Membership ends.

Automatic renewal. Every subscription renews automatically at the end of each billing period (monthly, or yearly for a Grant) and your payment method is charged the then-current price for your plan, until you cancel. You authorize us, through our payment processor Stripe, to charge you on each renewal.

Cancelling. You can cancel any time from Manage subscription in the Campfire Shop, or by emailing us. Cancellation takes effect at the end of your current billing period. You keep access until then, and you won't be charged again.

Failed payments. If a renewal payment fails, Stripe will retry it for a few days and your access continues while it does. If the payment can't be collected, the subscription ends and the features it unlocked stop working. If you host a space, it will be put out.

Free and promotional access. We may offer trials, promo codes or complimentary ("comped") plans. These are at our discretion, may have extra conditions shown when you get them, and can be ended by us at any time. Unless stated otherwise, a trial converts into a paid subscription when it ends unless you cancel first.

9. Coins and virtual items

Campfire has virtual currencies: Campfire Coins, which you can buy or earn, and creator coins, which are tied to one creator's space and earned there. Campfire also has virtual items, such as wearable garments. These are all together called "Virtual Items".

10. Prices, payment and taxes

Prices are shown in U.S. dollars in the Shop and at checkout before you pay. Payments are processed by Stripe; we never see or store your full card number. You agree to Stripe's terms for the payment. You're responsible for any taxes that apply to your purchase, which will be shown at checkout where we collect them.

We may change prices. A price change for a subscription applies from a renewal after we've told you about it, and you can cancel before then if you don't want to continue. We may correct pricing errors, and may cancel an order placed at a clearly wrong price (refunding anything you paid).

11. Refunds

Our Refund & Cancellation Policy is part of these Terms. In short: subscription payments aren't refunded for partly used periods, and digital purchases are delivered instantly and are generally final. We always follow consumer-protection laws that give you more rights, and we'll fix it if something you bought didn't work.

12. Ending your account

You can delete your account any time from your account page on Campfire. Deleting it cancels your subscriptions immediately, puts out any space you host, and removes your profile and uploads as described in the Privacy Policy. Unused subscription time, coins and items are not refunded when you delete your account.

We may suspend or end your account, or your creator status, if you break these Terms, if we must for legal reasons, or if your account creates risk or harm for others. Where it's reasonable we'll tell you why. If we end your account without cause, we'll refund the unused part of any prepaid subscription. Sections that by their nature should survive (such as content licenses already used, Virtual Items, disclaimers, limits on liability and disputes) survive the end of these Terms.

13. Changes to Campfire

Campfire is actively developed. We may add, change or remove features, and features may move between free and paid plans. If we remove a major paid feature you're currently paying for, we'll tell you in advance, and you can cancel. If we shut Campfire down entirely, we'll give reasonable notice and refund the unused part of prepaid subscriptions.

14. Disclaimers

Campfire is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Campfire will be uninterrupted, error-free or secure, that it will keep working with Twitch or any other service, or that content posted by other users is accurate or appropriate.

15. Limits on liability

To the fullest extent the law allows, Campfire and its operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, audience or goodwill, arising from or related to the Service. Our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50.

Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these Terms limits liability that can't legally be limited.

16. Indemnity

If you break these Terms or the law, or Your Content infringes someone's rights, and that leads to a claim against us, you agree to cover the reasonable costs and losses (including legal fees) that result, to the extent the law allows.

17. Disputes and governing law

If you have a problem, please email support@campfireclub.lol first. Most issues can be sorted out quickly that way, and we'll try in good faith for at least 30 days before either of us goes further. These Terms are governed by the laws of the United States and of the state in which Campfire's operator resides, without regard to conflict-of-law rules. Either of us may bring an individual claim in small-claims court. If you live outside the United States, you also keep any rights your local consumer laws give you that can't be waived.

18. Changes to these terms

We may update these Terms as Campfire changes. We'll change the "Last updated" date above, and for meaningful changes we'll notify you in Campfire or by email before they take effect. If you keep using Campfire after a change takes effect, you accept the new Terms. If you don't agree, stop using Campfire and cancel any subscription.

If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't waived it. These Terms, together with the Privacy Policy and the Refund & Cancellation Policy, are the whole agreement between you and us about Campfire. You can't transfer them; we may transfer them to a successor running Campfire.
